What is the Patent Agent Exam?

The Indian Patent Agent Exam is an assessment conducted by the Indian Patent Office every year to test the knowledge about the Indian Patents Act 1970 and the practical knowledge about drafting specific patent claims as well as good interpretative skills.

Who is a Patent Agent?

A patent agent is an individual who drafts as well as files patents for inventors or applicants. They represent clients before the Controller of patents to get the patent granted. In other words, they are involved in all the tasks of obtaining a patent and dealing with the legal aspects linked with it.

Educational Qualification for the exam

The candidate should fulfil the following conditions as per the section 126 of the Indian Patents Act 1970:

  1. S/he should a citizen of India;
  2. S/he should have completed 21 years of age; and
  3. S/he should have obtained a degree in science, engineering, or technology from a university established under law in the territory of India.

Patent Agent Exam Structure and Requirements

To qualify for the Indian Patent Agent Examination, candidates must appear for the following:

Paper I (Patent Act and Rules):

An objective test of 2 hours concerning with the Indian Patents Act and Rules.

Total 100 marks:

  • Part A(60 Marks): 30 multiple choice questions (30*2 Marks)
  • Part B (10 marks): True or false, 10 questions (10*1 Marks)
  • Part C (30 Marks): 10 multiple choice questions(10*3 Marks)

Candidates need to pass a minimum of 50% in this paper. It aims to ascertain the students’ understanding of the Indian Patents Act and the related rules.

Paper II (Drafting & Interpretation of Patent Specifications and International Treaties):

A descriptive test of 3 hours, focused on testing the ability of the candidate to draft the patent documents and interpret the patent legislation.

Total 100 marks:

  • Part A (20 Marks): 4 questions (4*5 Marks)
  • Part B (30 marks): 3 questions (3*10 Marks) 
  • Part C:  It has 3 parts:
  • Part C1: 2 questions (Any 1*10 Marks)
  • Part C2: 3 questions (Any 1*10 Marks)
  • Part C3: 4 questions (Any 1*30 Marks )

Candidates have to secure a minimum of 50% marks in this paper that deals with the preparation of the patent specification and the understanding of other allied documents.

Viva Voce

Total 100 marks.

Candidates who have a secured an aggregate of 60% in both paper I and II qualify to appear for the Viva-voce which further tests candidates on their understanding of the Indian Patents Act and its practical implications.

  2. Review and Submit: Ensure to enter all the required information correctly and submit.
  3. Payment: Finalize the application by making the fee payment through the tab known as ‘Make Payment” with the prescribed fee of Rs.1000/.
  4. Preview and Print.

How to prepare for the Patent Agent Exam 2025?

The Indian Patent Agent Exam is a very competitive examination that demands lot of preparation as well as nice and in-depth knowledge of patent laws, patent drafting, and interpretation of case laws.

Tips for Paper-I:

  1. Buy a copy of the Bare Act and start reading the sections and amended rules. Find a correlation between the sections and the rules.
  2. Download the current Patent Manual from https://www.ipindia.gov.in/.
  3. Familiarize yourselves with the recent case laws and amendments to the Patents Act and the Rules.
  4. Previous years question papers should be analyzed to know the most frequently asked questions.

Tips for Paper-II:

  1. Master the fundamental concepts of patent drafting and practice writing claims of the patent specifications.
  2. Learn the basics of Patent Cooperation Treaty.
  3. Read about treaties and conventions like Budapest Treaty, Paris Convention, Madrid Convention, CBD, GATT, WTO, etc.

A patent agent, being familiar with the patent laws and also the field of technology, has very good job prospects in different areas. Openings are available in the IP cells of R&D-oriented organizations and firms of patents, attorneys, and solicitors in which the duties entail drafting patent specifications, filing the patent applications, and prosecution.

India presently has close to 2900 registered patent agents, and this is far from adequate, especially in the present age. There is a need of fresh talent in the field of patent law and technology.
